Skilsmässa är fullt accepterad inom islam. Det bör dock poängteras att skilsmässan är en absolut sista utväg och för att säkerställa att alla alternativ är uttömda måste vissa åtgärder vidtas. Inom islam har det beskrivits vissa åtgärder som måste fullbordas före, under och efter skilsmässans verkställande. Behov hos både parter beaktas. Barn ges högsta prioritet. Religiösa riktlinjer finns både för personligt beteende och den rättsliga processen. Profeten Muhammed har anfört: ”Av alla lagliga saker, är skilsmässa den mest hatade av Allah.” Alla äktenskap har upp-och nedgångar. Nedgångar kan vara mer eller mindre djupa. I ett första steg bör därför äkta par utvärdera relation sinsemellan, söka sina hjärtan och försöka hitta anledningar till förening. Ett beslut om skilsmässa bör inte komma fram lätt. Innan du begär skillsmässa, Fråga dig själv: ”Har jag verkligen försökt alla möjliga utvägar?” Utvärdera dina behov och svagheter. Tänk igenom konsekvenserna. Försök att komma ihåg din partners goda egenskaper. Ha tålamod, och försök hitta förlåtelse i ditt hjärta. Kommunicera med din partner om dina känslor, rädslor och behov. Ta kontakt med Imam Ali Islamska Center för opartisk rådgivning om hur ni kan försöka rädda äktenskapet. Observera dock att detta enbart erbjuds av en religiös ledare/skriftlärd (sheikh/roohani). Kontakta Imam Ali Islamska Center för personligt möte. "Parterna bör antingen hålla ihop på rättvisa villkor, eller separera med vänlighet." (Surah al-Baqarah, 2:229) Om separation skulle visa sig vara oundvikligt, finns det ingen skam i att begära skilsmässa. Allah har upprättat detta som ett alternativ, eftersom det ibland är det bästa alternativet. Ingen behöver vara i en situation som orsakar lidande och smärta. Att på ett fredligt och vänskapligt sätt gå skilda vägar är då mer barmhärtigt.
 
 
 

 

Följande handlingar erfordras för uträttning av religiös skilsmässa:

  • Blankett 140 - Ansökan om religiös skilsmässan.
  • Blankett nr 111 - Registrering av medlemmar och betjänade.
  • Personbevis (Ämne: Familjebevis. Personbeviset ska inte vara äldre än en månad)
  • Kopia på en giltig Svensk ID-handling (t.ex. pass, id-kort, körkort etc.
  • Kopia på hemlandets giltig ID-handling (Endast för medborgare med utländsk bakgrund som vill registrera sin skilsmässa i sitt hemland).
  • Avgiften är 1875 SEK (inkl. 25% moms) och ska betalas antingen i centret (med kort eller kontant) eller via Plusgiro.nr: 643195-1 (Imam Ali Islamic Center)

 

OBS! Det krävs att boka en tid i förväg för att kommer till centret och lämna in skilsmässoansökan. Tidsbokning sker via telefonnummer 0858012314.

 

 


 

 

Observera att:

  • Enligt cenrets policy måste både maken och makan ge sitt samtycke för att få hjälp med äktenskapsskillnad. Centret utför inte ensidig skilsmässa.
  • Handläggning av ansökan sker av Svenska Islamiska Unionen (SIU).
  • Ni måste kontakta oss och boka en tid i förväg innan ni kommer till centret och lämnar ansökan.
  • En kvinna som är skild är pliktig att vänta tre månader innan hon kan gifta om sig. Kvinnans väntetid kallas för ”Iddah”
  • Kvinnor som vid vigseln, föreskrev villkoret att ha fullmakt från mannan att själv kunna skilja sig, kan vända sig till Centret för att ansöka om skilsmässan.
  • Ifall där makan (som inte har någon skilsmässofullmakt) ansöker om skilsmässan men mannen vägrar acceptera, kan kvinnan vända sig till Centret med en skriftlig kortfattad redogörelse över situationen och därmed anledningen till sin ansökan. Imamen kommer alltefter möjligheterna hitta och fullgöra lösningar på problemet.
  • Om handlingarna ska skickas in per post, måste signaturerna vara vidimierade av Notarius Publicus (detta är inte nödvändigt om handlingarna inlämnas personligen- kontakta en advokatbyrå för mer information om notarius publicus).
  • Skicka aldrig orginalhandlingar.
  • Enbart kompletta handlingar kommer att behandlas.

Typ av skilsmässa inom Islam

Talagh* Raji (reversibel skilsmässa)När skilsmässan har verkställts börjar den så kallade Iddah perioden för hustrun. Under denna period som är tre mensperioder kan paret förenas utan vigsel och skilsmässan annulleras. Denna typ av skilsmässa är den vanligaste och rekommenderas också från Imam Ali Islamic Center. Handläggningstiden för denna typ av skilsmässa är mellan 4 till 6 veckor.

Talagh Khule: I motsats till Raji är denna en irreversibel skilsmässa och paret kan inte förenas utan vigsel när skilsmässan har verkställts. Ett krav för att skilsmässan skall kunna verkställas är att kvinnan måste avstå sin rätt till hemgift (mehrieh). Dessutom krävs det mycket starka skäl för att talagh ba'in skall beviljas. Denna typ av skilsmässa är ovanlig. Det tar cirka 7-8 månader för att behandla ärendet.

Talagh Mobarat: I denna typ av skilsmässa är det hustrun som kräver att få skilja sig. För att skilsmässan skall verkställas måste kvinnan lämna tillbaks pengar och egendom som mannen införskaffat under äktenskapet (observera, inte allting utan vissa egendom och pengar). Denna typ av skilsmässa är mycket sällsynt. Det kan ta upp till 8 månader innan skilsmässan verkställs.

Divorce (Talaq)
 
Introduction
 
 “Talaq” is an Arabic word, within an Islamic context, which means divorce. 
Divorce is allowed in Islam, but as an absolute last resort when all the other options are depleted. Islam requires certain measures to be carried out prior, during and after the finalisation of divorce. The needs and grievances of both parties are taken into consideration. The rights of any children is given highest priority. These measures cover both personal as well as Islamic civic jurisprudential aspects. The prophet Mohammed (S.) is reported to have said: “Of all the allowed deeds, divorce is the most hated by God.”
One should bear in mind that all marriages have ups and downs, some of the latter can be very grave. Therefore, as an initial step when facing serious difficulties in relationships, is for the couple to evaluate their relationship, and try to find it in their hearts reasons to stay together. A decision for separation shouldn’t come about easily. Before any thoughts of divorce, one should ask: “Have I truly tried all possible resolutions?” 
Evaluate your needs, your weaknesses, and contemplate on the consequences of such a decision. Try to remember your spouse’s good properties. Have patient, and try to find forgiveness in your heart for your spouse’s shortcomings. Communicate with your partner about your feelings, fears and needs. Concerning separation, God swt says in the holy Quran: “…then [let there be] either an honourable retention, or a kindly release. …” [2:229] God swt has made divorce a permissible way, when there is no other way. No one should remain in a position of pain and suffering. Therefore, to divorce and separate respectfully in a peaceful manner is a possible method to avoid a chronic pain and suffering, if dictated by an unhealthy relationship.
 
 
Different types of divorces within Islamic jurisprudence
Below is a brief description of the most common types of divorce procedures in Islamic jurisprudence. To enquire for other less common types of divorce procedures, please contact us
 
 
Talaq Raji (Reversible divorce): When divorce procure is finalised, a period of the so called “Iddah” starts for the female divorcee. “Iddah” lasts three menstrual cycles. During “Iddah” the divorced couple have the ability to re-unite as a married couple. This is the most common type of divorce and it is recommended by Imam Ali Islamic Center. The processing time for Talaq Raji is around 4-6 months.
 
 
Talaq Khule: Contrary to Talaq Raji, Talaq Ba’in is irreversible. One condition required for this divorce type is that the wife has to cede her right to the dowry to her husband. This type of divorce is very rare and requires very strong grounds for justification. The processing time for Talaq Ba’in is around 7-8 months.
 
 
Talaq Mobarat: This type of divorce is specifically designed to preserve the rights of the wife, as it can only be requested by her. However, for this type of divorce the wife needs to return certain properties and money that was given to her by her husband. The processing time for Talaq Mobarat is up to 8 months.
 
 
 
 
 
Practical aspects
Required forms and documents prior to your appointment:
 
  • Form number 140 (Application for a religious divorce)
  • Form number 111 (Imam Ali Islamic Center visitor registration form)
  • Paper copy of a Swedish ID (For example passport, ID-card, driving licence etc.)
  • “Personbevis” (civic registration certificate), titled “Familjebevis”. Please note that this document should not be older than one month. Personbevis can be ordered through Skatteverket (Tax authority). Click hereto read more about Personbevis and how it can be ordered.
  • Paper copy of Iranian ID-document, “Shenasnameh”. (Only relevant for Iranian citizens who want to be able to register their divorce in the Islamic Republic of Iran.)
  • 1875 SEK fee (including 25% VAT.). The fee can be paid either by pay card or cash during your visit to the center. It is also possible to prepay the fee prior to your appointment through plusgiro bank transfer. Imam Ali Islamic Center’s plusgiro account is 643195-1.

 

 

 

Note:
 
  • According to the center's policy, both husband and wife must give their consent to get help with divorce. The center does not perform unilateral divorce.
  • Please note that only fully and correctly filled forms and documents can be accepted.
  • An appointment must be booked for divorce application. This can be done through a telephone call to us.
  • According to Islamic jurisprudence, a divorced female has to wait three menstrual cycles before she can remarry. This waiting period is called “Iddah”.
  • Females who had a precondition in their marriage contract to be able to divorce themselves without the authority of the husband (ie. Divorce mandate), can contact us for implementing the procedure.
  • Females without divorce mandate can write down a cover letter to us, where they in brief explain the background for why they would like to request divorce. The expert scholar will use this as the blueprint for building a case for initiation of divorce procedure.
  • If any documents or forms are to be sent to us through postal services, the signatures must be verified through Notarius Publicus. Please contact a law firm for more details. Note that this is not a requirement when the documents are submitted to us in person.
  • Never send original documents or certificates.
